Response
from SEPA to request for information regarding emission breaches, provided
on 8 June 2010
Tallow / Waste and WID
Dundas combusts tallow in its N02 odour abatement thermal oxidisers and steam raising boiler
plant. As a consequence these were made subject to the Waste incineration Directive (“WID’1
2000/76/EC) and the Waste Incineration (Scotland) Regulations 2003 (SSI 2003:170) at the time
the Permit was issued in October 2007.
However a change in EC legislation in terms of the Animal By-Products Regulation, coming into
effect in March 2011, has led SEPA to review the overall regulatory situation concerning the
Tallow/ Waste / WID issue as under noted:-

An amendment to the Animal By Product Regulations removes the mandatory requirement
to apply WID to the burning of tallow; and
-
The new Waste Framework Directive 2008/98/EC excludes all ABP (rather than just whole
carcasses) from the scope of the Waste Framework Directive except under circumstances
where this is to be incinerated, landfilled or used in a biogas or composting plant.
Arising from the above an enforcement position has currently been taken by SEPA and the
Scottish Government with respect to WID, in so far as this applies to the burning of tailovv as a
fuel, namely:-

The compliance with WID not to be sought until 4 March 2011; and

During the period from now till 4 March 2011, SEPA will actively engage with operators to
timeously progress a site specific end-of-waste case for each of the rendering sites in
Scotland
